NEW MAXIMUM THC CONCENTRATIONS FOR MARIHUANA-INFUSED PRODUCTS

The Bureau of Medical Marihuana Regulation (BMMR) enforce the Administrative Rules under the authority of the Medical Marihuana Facilities Licensing Act (MMFLA).

Administrative Rule 62 (R 333.262) states that marihuana-infused products processed, sold, or transferred through provisioning centers must not exceed the maximum THC levels as established by the department.

For the purposes of maximum THC levels for marihuana-infused products, the department shall publish a list of maximum THC concentration and allowable dose limits.

This technical bulletin does not constitute legal advice and is  subject to change. Licensees are encouraged to seek legal counsel to ensure their operations comply with the Medical Marihuana Facilities Licensing Act and associated Administrative Rules.

Changes from the previous Emergency Rules include:

• The limits were removed for topicals as they are not designed to be transdermal.

• The limits were lowered for edible maximum per container to be more in line with other states (Oregon, Washington).

• THC limits were increased for capsules to allow for more in the container.

• Dosages were added for products that did not have them; containers will now have clear directions and dosages to ensure patients do not over medicate.

• Patients typically start with 10mg servings; an allowance between 50mg -100mg allows a patient/caregiver to purchase higher strength medicine if needed.

The Medical Marihuana Licensing Board’s September 15th deadline for unlicensed provisioning centers to shut down is approaching fast. Originally the deadline was June 15, 2018, but the state licensing office moved it due to an apparent  backlog in processing applications

Only about 16 licenses out of a reported 637 applications have been approved.

There are approximately over 200 provisioning centers operating temporarily under state emergency rules. Most will have to shut down on the deadline date.

There are licenses that have been approved which include cannabis businesses in each of the five classes of operation in the state regulatory system.  Even if there are more licenses approved at a meeting scheduled Sept. 10 meeting, it might only be a few.

“The implementation is insufficient,” says attorney Josh Colton of  the Komorn Law firm. “Patients need safe access to their medicine. Extending the deadline from June to September was for this purpose. To all of a sudden shut this down is going to leave quite a few people scrambling.”

There are approximately 300,000 Michigan medical marijuana patients. The licensing bureau has calculated that two-thirds of the patients live within 30 miles or so of a county where one of the licensed provisioning centers is located.

“Even though I think [MMLB] are doing everything they possibly can, even if they are successful in getting 20 more facilities licensed, it is simply not enough to take care of the patient base,” says Colton.

Prohibited Appearances and Packaging of Medical Marihuana Products

The Medical Marihuana Facilities Licensing Act Emergency Rules establish protocols regarding edible marihuana products. Per Rule 33, the term ‘edible marihuana product’ means any marihuana-infused product containing marihuana that is intended for human consumption in a manner other than smoke inhalation. It is important to note the following:

No edible marihuana product can be in a shape, color, package, or labeled in a manner that it would appeal to minors aged 17 years or younger. No edible marihuana product can be associated with or have cartoons, caricatures, toys, colors, designs, shapes, labels, or package that would appeal to minors.

 

• No edible marihuana product can be easily confused with commercially sold candy. The use of the word candy or candies on the packaging or labeling is prohibited.

 

• An edible marihuana product must be in child resistant packages or containers

 

• A processor is prohibited from producing an edible marihuana product that requires time or temperature control for safety. The end-product must be a stable shelf-life edible marihuana product.
