Tonight- Americans for Safe Access published a white paper entitled ‘Third Time The Charm?’ which focuses on the existing medical marijuana laws and efforts in each state and how they may comply with the Cole memo and DOJ policy, including HB4271 in Michigan which will be heard December 5th in the House Judiciary Committee.
Mike Liszewski- legislative analyst from ASA in DC, and who was heavily involved with the recent ASA report, will join us to discuss this recent publication, possible future reports to be published by ASA and his and ASA’s assessment of HB4271.

Tonight- The state of Washington, one of two to successfully win cannabis legalization at the ballot in 2012, is preparing to implement and govern the state’s new legal cannabis market. What does this mean to the existing medical marijuana program there and how is the regulatory scheme in Washington viewed by the Federal government? Also the Michigan Court of Appeals has issued a published opinion in the case of People v Hartwick in which section 4 protections and the affirmative defense of section 8 in the Michigan Medical Marihuana Act were denied. The COA also upheld the disqualification of District Court Judge Somers in Dearborn due to comments he made about cannabis and the MMMA, in a previous case.
Joining us tonight will be Kari Boiter, nationally recognized medical marijuana activist and champion for drug war prisoners and criminal justice reform, from Seattle, WA.
Also calling in will be friend of the show and attorney Neil Rockind “The Rockweiler” of Rockind Law who is responsible for having the biased Judge Somers disqualified from a medical marijuana case. Neil will also join Michael in discussing the real meaning and implications of the published COA opinion in P v Hartwick.

Tonight- The Michigan State Senate passed SB660 on Wednesday Nov. 13, which would allow medical marijuana patients the option of obtaining up to two ounces per month of tested cannabis from a pharmacy in lieu of participating in the Michigan Medical Marihuana Program. Also Michigan representatives and senators, along with a representative of the National Patients Rights Association (NPRA), visited the Canadian company in Saskatoon, responsible for the powerful lobbying effort behind the “pharma grade” marijuana bill.
Joining us tonight will be the Michigan Senate Minority Leader Gretchen Whitmer from East Lansing, who spoke in opposition to SB660 on the Senate floor and offered amendments to the bill that would include “tie barring” House Bills 4271 a local option bill for dispensaries, and 4623 a bill to decriminalize adult use of small amounts of cannabis, which were defeated.
Robin Schneider, the Legislative Chairwoman for the NPRA visited the Prarie Systems operation in Saskatoon Canada along with Michigan State Representatives and Senators. While there, Robin spoke with members of the Canadian Parliament and those responsible for growing and providing medical marijuana to Canadian patients.

Senate Bill 660, a Canadian company- Prairie Systems funded legislative effort to establish a parallel medical marijuana growing and distribution system apart from the MMMA, was heard in Senate committee and attended by several advocates who spoke out in opposition.

Three cities Ferndale, Jackson and Lansing have local marijuana decriminalization initiatives on the ballot for the upcoming election Tuesday, Nov. 5. And, Baby Bree is back home!

Update on Federal POW Jerry Duval who continues to have issues with his significant medical conditions in prison.

Tonight- The Michigan Medical Marihuana Act offers immunity from prosecution and/or defenses for the patients and caregivers participating in growing and/or using cannabis. These protections are, often times, largely based on the establishment of a doctor-patient relationship. We will discuss the kinds of standards being employed around the state for patients obtaining recommendation letters, and whether or not certain practices may create advantages or disadvantages when and if legal issues arise for the caregivers, patients and recommending doctors.
One of the main questions being discussed tonight- Does it make a difference if the doctor’s examination and subsequent recommendation was performed at a business expo, hotel or other festival like event? Joining us in this discussion will be:
Ben Horner from the MMMR Report Magazine, and organizer and creator of a series of marijuana conferences which include pertinent speakers, classes on related subjects, industry vendors and a doctor for offering recommendation letters for new or renewing patients.
Two physicians, Dr. Singh, and Dr. Crocker who both offer examinations and recommendations for marijuana patients as a part of their respective practices.

Tonight- The Michigan Supreme Court heard oral arguments today in Ter Beek v City of Wyoming. The case stems from the City of Wyoming excluding medical marijuana activity by way of banning all behavior that is Federally illegal, within in the city. The decision could potentially put into jeopardy the ability for medical marijuana patients to continue using cannabis under state law.
Attorney John Targowski will join us tonight along with the Godfather Tim Beck, who attended the hearings earlier today. We will discuss the implications of the MSC potentially ruling on the side of the City of Wyoming in favor of Federal preemption, and what the predominant thinking is on which way the court is leaning after today’s hearing.
We will also hear from Kevin Spitler the organizer of the Ohio Rights Organization event coming up this weekend on Saturday Oct. 12 at Headliners in Toledo beginning at 7:00 pm. Kevin will be checking in from the Cannabis Counsel in Detroit where national figure, and last week’s guest, Cheryl Shuman will be participating in a gathering of organizations and activists during her brief visit in Michigan before participating in a tour of Ohio including this weekend’s event in Toledo.

Tonight- Cheryl Shuman, considered to be one of the most visible women in the medical Cannabis reform movement. Coined the “Martha Stewart of marijuana,” she has built the largest Cannabis media source in the world. Founder of the Beverly Hills Cannabis Club in California. Originally from Ohio, Cheryl will be returning home to help pass the Ohio Cannabis Rights Amendment. She will also be making a stop in Michigan to attend a presentation by medical marijuana opposer Kevin Sabet in Troy followed by a gathering of activists and organizations at the offices of the Cannabis Counsel in Detroit.
Steve Green of the MI Human Solution chapter will offer a report of upcoming court dates involving defendants in need of support and update us on his and wife Maria’s ongoing battle with the CPS and the courts.
We will also check in with offices of the Cannabis Counsel where the birthday celebration of John Sinclair will be taking place tonight, and wish John a happy birthday.

Tonight- – How to handle traffic stops by law enforcement for medical marijuana patients and caregivers- Republicans from Michigan and around the country met on Mackinac Island last weekend, and an update of the persecution of the Green family from CPS in Ingham County and Judge Bowman and the Oakland County Circuit Court.
Joining us tonight will be former clients of Michael Komorn, Heather and Peairr Jordan, along with attorney David Rudoi of Rudoi Law to discuss traffic encounters with police. Heather and Peairr have had traffic stop incidents with police in different counties,We will discuss what to do, what the police can and can not do, and how to avoid or minimize possible negative consequences under such circumstances.
Godfather Tim Beck attended the recent Republican gathering on Mackinac Island and will report on the weekend meeting including the public and personal conversations with key Republic leaders and their thoughts on marijuana reform issues.
