Get Out and Vote.

Komorn Law receives questions on a daily basis from medical marijuana patients, growers and prospective marijuana business owners about how it differs from the current Michigan Medical Marihuana Act.

The ballot is expected to pass and it is important for Michigan marijuana business owners to know what the ballot initiative is about.

Officially called the Michigan Regulation and Taxation of Marihuana Act, was written by the Coalition to Regulate Marijuana Like Alcohol (RMLA).

The main proposals in the ballot.

Here is a brief look at the Age Regulations…

AGE REGULATION

  • It allows the personal possession and use of marijuana by anyone 21 years of age or older
  • Provides for the lawful cultivation and sale of marijuana and industrial hemp by anyone 21 years of age or older
  • The act does not replace the Michigan medical marijuana laws but instead provides a regulatory rules for recreational marijuana. The regulation would be that a person between the ages of 18 and 20 could possess medical marijuana with a valid medical card; but that same person could not possess recreational marijuana until they turn 21.

Canada Legalizes Cannabis-Oct 17 2018

Canada Legalizes Cannabis-Oct 17 2018

In case you have been sleeping under a rock for the last few years or have had kids and only watch cartoons… it has happened. Canada Officially Legalized Recreational Cannabis at midnight on October 17, 2018.

Historical Quotes

“A date which will live in infamy”…”This is one for the history books”…”We spend a great deal of time studying history, which, let’s face it, is mostly the history of stupidity.”

What will be the famous quote for this Canadian historical event…”It’s about time..eh!!”.

Congrats Canadians

You have now became the largest country in the world with a national legal marijuana marketplace.

BONUS – Hours before a federal official told The Associated Press that Canada will pardon all those with convictions for possessing up to 30 grams of marijuana, the now-legal threshold.  That’s just about an ounce…but it’s a start.

Enjoy it.  The US is not going to let you have all the glory or revenue for too long.

Anyhow…….

Different Ways

The war on this “drug” has ruined so many lives, several generations and derailed the potential future of so many people that could contribute to the creation of so many good things…in so many different ways.

The next step is clearing the “criminal records” of those who were railroaded, imprisoned or bullied into pleading by prosecutors and law enforcement who are allowed to use every trick in the book (they wrote).   It’s time to bring those to light…in so many different ways.

The step after that is compensating for the lost time, the money, the life savings and potential that were taken away in the process of defending ones self or the time spent in prison.  There is no price for lost time which can not be returned.  There is no dollar amount that can be accurately calculated.  For every one dollar should be estimated as losing twenty…in so many different ways

Under A Different Light

As the process of legalization creeps it’s way through the USA let us not become sheep.  Let us move forward, work harder and create.

Of course the human factors such a power, greed and corruption will still play a part in the legalization process and business part but it will be under a different light.

Of course it will take generations of law enforcement to get the concept of recreational cannabis.  They will still find away to make money and destroy lives but it will be under a different light.

Of course the Government will tax it,  figure out how to control it and continue to cause conflicts about it so they can keep spending our money and keeping their jobs.  That’s human nature… but now it will be under a different light.

Of course there will those who will oppose it and those who want more of it.   As long as we don’t pound each other into submission that’s how compromise and progress happens. With cannabis being legal the battle will now be (yes I am going to say it just to mess with the robots)… under a different light.

Let these historical moments be one of the good victories for the people who were victimized by the system.

About Proposal 1 – Regulate Marijuana Like Alcohol

About Proposal 1 – Regulate Marijuana Like Alcohol

Voters will decide whether to approve recreational marijuana for adult use in Michigan. A “yes” vote on Prop 1 would legalize adult cannabis use, while a “no” vote would continue to only allow access in Michigan for medical marijuana.

Marijuana is one of three proposals on the ballot this year. (The others involve redistricting (Prop 2), and voting rights (Prop 3)

If the vote for legalization were today, polls suggest Michigan would give Cannabis the yes vote. The group leading the charge is The Coalition to Regulate Marijuana like Alcohol .

Organized by the D.C. nonprofit The Marijuana Policy Project, the Coalition to Regulate Marijuana like Alcohol is comprised of a variety of advocate groups and stakeholders. The Marijuana Policy Project works to change state-level marijuana laws and increase public support for “non-punitive, non-coercive marijuana policies.” Among the Coalition members are the Marijuana Policy ProjectMI LegalizeMichigan NORML, the ACLU of Michigan and the Drug Policy Alliance.

Founded in 1995, The Marijuana Policy Project, (MPP), a D.C.-based nonprofit, worked with the Michigan group MI Legalize to organize the stakeholders that now make up the Coalition to Regulate Marijuana like Alcohol (CRMLA). In addition to MPP and MI Legalize, members include the ACLU of MichiganMI LegalizeMichigan NORML, and the Drug Policy Alliance.

Billionaire Peter Lewis of Ohio, head of Progressive Insurance, was a major donor until his death at age 80 in 2013. It is reported that his family continues to donate to MPP, as well as New Approach PAC, another CRMLA donor.

DEMOCRATIC CANDIDATE FOR GOVERNOR GRETCHEN WHITMER’S TAKE: “Michigan has a chance to get marijuana legalization right. I will be a yes vote on legalizing recreational marijuana when it appears on the ballot this November. As governor, I’m going to make sure we regulate marijuana so it doesn’t get into the hands of our kids and tax it so the money goes to fixing our roads and our broken education system,” Whitmer said to Bridge Magazine via email.

REPUBLICAN CANDIDATE FOR GOVERNOR BILL SCHUETTE’S TAKE: Schuette said to Bridge Magazine in an interview, “I believe in democracy and so if the citizens of Michigan pass it I will implement it fully, completely,  according to the statute and and make it work if it’s passed… From my perspective, we don’t need to put more drugs in the hands of children…so I’m voting no on that.”

BENEFITS OF PROP 1:

  • Increased tax revenue: Legalization would create a new revenue stream for schools, transportation, and local governments. States such as Washington and Colorado have harvested millions of dollars in additional taxes. Experts estimate Michigan could make 100 million to 200 million dollars a year from marijuana taxation.
  • Falling arrest rates: States with recreational cannabis have seen arrest rates fall for marijuana-related offenses, keeping people out of the penal system and in the workforce. (It is worth noting that, while arrest rates fall overall, racial disparities in arrest rates do not vanish, with minorities continuing to be arrested at higher rates than whites.)
  • New jobs and businesses: A new industry expands the private sector, opening the door to more businesses and jobs.
  • Health benefits: Research indicates there could be some positive impacts, such as alleviating pain, nausea, seizures, and potentially helping users fight insomnia.

CONCERNS:

  • Health risks: Despite marijuana’s medicinal uses, it can be injurious to users’ health. Those prone to mental illness and adolescents whose brains are still developing seem to run the highest risk of ill effects, and “substantial” use can harm anybody’s lungs.
  • Public safety: There are concerns about road and worker safety. There is no test to assess whether or not a person is currently under the influence of marijuana, making it difficult to police the roads for drivers under the influence or identify impaired workers on the job. At the moment, research is muddled as to whether there is any effect at all on transit safety, positive or negative.
  • Hiring difficulties: Michigan employers are worried about finding workers that can pass a drug test. There are already areas of the state struggling with this issue, and some companies fear that easy access to weed will only exacerbate the problem.

Don’t worry – The Government will figure out many ways to make money as they always do.

The amount they give away in lawsuits most likely negates the amount they take in from putting people in jail or forfeiture anyway.  Why not remove the lawsuit factor and collect free money…Duh

Thousands Of Absentee Michigan Voters Get Wrong Instructions

Thousands Of Absentee Michigan Voters Get Wrong Instructions

Thousands of absentee voters were mistakenly sent instructions on how to vote a straight-party ticket even though that’s not an option in next month’s Michigan election.

The Lansing State Journal reports Meridian Township Clerk Brett Dreyfus says about 5,000 ballots were sent before the problem was discovered.

Dreyfus blamed a vendor for sending incorrect instructions but acknowledged his office should have caught it before mailing absentee ballots in the Lansing-area community.

The township noted the error in a posting on its website.

A federal appeals court last month revived Michigan’s ban on straight-party voting. Voters must go line by line if they want to vote for candidates in partisan races. In the past, a single mark could automatically count for candidates of a single party, from governor to county commissioner.
