Maintaining a Drug House in Michigan
In Michigan, maintaining a drug house is considered illegal. A person who is suspected, accused or charged of drug activity such as maintaining a location where illegal drugs or controlled substances are kept, sold, or used by others such as a home, building, store, or other structure may be arrested for maintaining a drug house. Even if a person is not actually charged, they may still face a civil fine of up to $25,000 if penalized by the state.
Maintaining a Drug House in Michigan is a high-court misdemeanor punishable by two (2) years in prison and other penalties. High-court misdemeanors are prosecuted the same way as felony cases, but are technically a “misdemeanor” by statute.
What Prosecutor Must Prove
The prosecutor must prove beyond a reasonable doubt that you are guilty of the offense. To prove that someone is guilty of maintaining a drug house, the prosecutor must prove that:
- The individual had knowledge of the drug house,
- The individual did keep or maintain a drug house,
- A vehicle or building was frequently used in violation of the controlled substances laws in Michigan
Don’t Forget
- The Police may legally lie, bluff, mislead and intimidate you.
- Most “avoidable arrests” occur from trickery and intimidation and failing to understand your rights and when to assert them.
- Refusing to answer questions is not an admission of guilt
- Asserting your right to remain silent is not an admission of guilt
- Demanding to have your lawyer present during any questioning is not an admission of guilt
- Refusing a search is not an admission of guilt.
