Komorn Law PLLC is proud to report a ruling today from the Genesee County Circuit Court.
This case involved my client’s property and all kinds of salacious allegations of really bad behavior by this property, and I mean bad stuff, like stuff you could never imagine property could actually do.
To add to the drama of all this unimaginable behavior by my clients property, the accuser was an ” entity” called FANG. The story for the last 3 years, told by the State ( the ATTORNEY’S for FANG) was that that the bad behaving property needed to be held by FANG, because it was bad behaving ( if this makes no sense, it is not supposed to).
Additionally FANG was of the opinion that because of these allegations they should be able to keep all of my client’s bad behaving property (there has been no conviction).
Today in the civil forfeiture against my client and his “allegedly evil” property the Court granted our motion for summary disposition ( no genuine issue of fact existed to which reasonable minds could differ) ultimately dismissing the forfeiture case and ordering the return of all that bad behaving property.

I hired Michael as my lawyer August of 2015 and we finally finished my case April of 2016, throughout the whole process Michael and his team kept me thoroughly updated. CLIO (WJRT) – (04/25/16) – A Mid-Michigan marihuana dispensary is fighting the Genesee County Prosecutor’s office in court after FANG shut them down.
The owner of the Clio dispensary says warrants weren’t valid and he wants his business back open.
Attorneys from both sides were in Judge Hayman’s court Monday afternoon. The raid happened in January when the Genesee County Prosecutor’s office filed an emergency injunction to close down a facility called Clio Caregiver Connection.
A counter claim was filed against the Prosecutor’s Office, saying the county failed to meet legal requirements to participate with FANG.
The defense also argues that the recent dispensary raids and padlocking efforts by FANG were and are illegal.
“I don’t write the laws. I just enforce them. Dispensaries are not allowed. The word dispensary does not even appear in the medical marihuana act,” said Prosecuting Attorney David Leyton.
“There’s never been any complaints from anyone. He’s loved by all of the patients that’ve gone in there. They’re all unhappy that this was forced down. And it’s just an overreach by FANG,” said Clio Caregiver Connection Attorney Michael Komorn.
The case is in its early stages. Both sides will return to court to discuss it again on May 16.
